Who owns the photos?

 

As you delve into the world of photography, it's crucial to understand the intricacies of client-photographer relationships, including the topic of photo licensing and usage rights.

Sounds like a mouth full right?

When a client purchases photos from a photographer, it's important to clarify that they are not buying the actual ownership of the photos. Instead, they are purchasing a license that grants them the right to use and print the images for specific purposes while respecting the copyright held by the photographer.

Here are some of the terms we use and need to know when becoming a photographer:

  • Licensing for Usage: When a client purchases photos, they are essentially buying the right to use those images. This typically includes personal use, sharing on social media, and printing for personal enjoyment. It's important to outline the scope of usage in your client agreements to avoid misunderstandings.

  • Copyright Ownership: As the photographer, you retain the copyright ownership of the images. This means that you have the exclusive right to reproduce, distribute, and display the photos. Your clients cannot alter, sell, or use the images for commercial purposes without your permission.

  • Commercial Usage: If a client intends to use the photos for commercial purposes, such as advertising or promotion, they need to obtain a separate commercial usage license from you. This ensures that both parties are aligned and the appropriate compensation is provided. Normally there is a a higher charge for that type of work since the business is using your images to make money.

    Educating Your Clients: Part of your role as a photographer is to educate your clients about these aspects of photo licensing. Clear communication upfront helps manage expectations and fosters a positive relationship. Most of our job is actually just educating our clients on the in's and out's of the photography business. You wouldn't expect to know the ingredients used to bake a cake you've ordered, same thing with our clients, they don't necessarily know the rules within the photography world. Most people are happy with a transaction that is clear in it's terms.
